Acting on the demurrer to evidence filed by Atty. Emiliano R. Deleverio, legal counsel defending his cousin, Mr. Anacleto “Boy” Deliverio, in the two libel cases filed by the most powerful politicians in the province, Judge Reinerio Abraham Ramas of RTC branch 18, Pagadian City, dismissed Case Nos. 6220-2kl and 6912-2k3, both for libel, after finding that the crime charged do not constitute an offense.(click right picture. Case No. 6220-2kl arose from the complaint of libel filed by 2nd District Congressman Antonio H. Cerilles who alleged that he was maligned by a letter sent to Mr. Deliverio accusing the congressman of land grabbing certain properties at Sumadat, Dumalinao, Zamboanga del Sur utilizing the Office of the DENR Secretary. Deliverio read the said letter on the air. Fortunately, during the reinvestigation, the supposed letter-writers were excluded from the complaint, leaving Deliverio alone to face the libel charges. Case No. 6912-2k3 arose from the complaint filed by Zamboanga del Sur Governor Aurora Enerio Cerilles who alleged that Deliverio insinuated on the air that she was the mastermind in the murder of broadcaster and editor Edgar Damalerio. The court found Deliverio’s commentary thereon as without malice, having propounded questions only to the governor, the PNP Provincial director and the city police chief of their suspected involvement in the said murder-killing, and Deliverio was only seen as exerting effort to contribute to the solution of the murder. The dismissal of the two libel cases came simultaneously in the later part of April 2007. The two motions to quash were necessary. Atty. Deleverio explained, because the prosecution failed to present evidence that would prove the guilt of the accused beyond reasonable doubt and that the charge did not constitute an offense. Boy Deliverio, who writes Pen power for Mindanao Monitor and other local news papers, did not care to report this significant development in his crusade against graft and corruption in government, until he was certain that no motion for reconsideration was filed by the complainants. According to the diminutive “stormy petrel” in local journalism, only one libel case remains to be resolved in the sala of Judge Rolando L.
