A migrant tribal leader in Bayog, Zamboanga del Sur who used the name of Pigsalabukan Gukom de Bayog (PGB) maliciously to impose a fine of P 120,00.00 on the National Commision on Indigenous Peoples (NCIP) for allegedly violating the customs and traditions of the tribe is now in hot water as charges are being readied against him.
Regional Director Celestino Talpis Sr., has instructed the commission’s legal officers to prepare the criminal complaint. Lucenio Manda, a pastor of still unknown religious congregation reportedly caused the publication in a local weekly that PGB has fined NCIP for allegedly violating the Subanen customs and traditions when it held a community consultative assembly outside the house of the acknowledged and recognized tribal leader in the area. In a fact-finding investigation conducted by the NCIP along with the acknowledged and recognized tribal leaders in Bayog, Zamboanga del Sur recently, Manda was found to have arrogated upon himself thru misrepresentation certain traditional powers that certainly do not belong to him or to the association that he misrepresented During the validation of the signatures appearing on the controversial penalty order, it was established that out of the 13 signatories, only five (5) were found to be authentic tribal leaders while the rest were not, to include Manda himself. Timuay Diosdado Lapar, in a statement said: “NCIP has violated nothing. What they did when they came here is respectable. The resolution made by PGB is a dishonor to the Subanen community and for the Council of Elders of Bayog, Mr. Lucenio Manda’s intentions are ill.” Timuay Ramon Lumigue added: “Mr. Lucenio Manda is not from Bayog.” NCIP Provincial Officer Henrico Gumibao explained in a forum during the fact-finding probe that the community consultative assembly is not to settle disputes but merely for consultation purposes as he demanded to confirm whether the fine imposed was initiated by the traditional leaders in accordance with the customs and traditions of the Subanen community in Bayog. He said that an authority in a Subanen community does not publish a decision but the mere presence of its leaders establishes its consistency and authenticity. Thus, he added, that the publication was ill-motivated and malicious to malign the National Commission on Indigenous Peoples (NCIP). NCIP Provincial legal officer Sumanghal G. Sagga said that the penaly order allegedly authored by a migrant Subanen should be disregarded saying “there is no crime committed when there is no law that punishes that crime”.
