PAGADIAN CITY - Pagadian City Police Chief Police Sr. Inspector Oscar Buenaobra was condemned for arrogance, gross misconduct, grave abuse of discretion and conduct unbecoming of an officer and a gentleman.

    In a joint manifesto signed and submitted by the Zamboanga del Sur and Pagadian City employees of the Regional Trial Court Branches 18,19,20,21,22,29 & 30, Municipal Trial Court in Cities branches 1 & 2, Office of Provincial and City Clerk of Court and Ex-Officio Provincial and City Sheriff, Office of the Provincial and City Prosecutor , Public Attorney’s Office, Parole and Probation Office and the Integrated Bar of the Philippines, Pagadian City and Zamboanga del Sur Chapter  to Hon. Rolando Puno, Secretary of the Department of Interior and Local Government, Director General Oscar C. Calderon, PNP Chief, Police Chief Supt. Jaime G. Caringal, PNP Regional Director and to Police Senior Supt. Ramon M. Ochotorena  Zamboanga del Sur PNP Provincial Director.

    In the said Manifesto, It stated the incidents occurred on June 1, 2007, at about 4:00 o'clock in the afternoon, P/SI Oscar Tan Buenaobra, Acting Chief of Police of the Pagadian City Police Station, entered the Bulwagan Ng Katarungan building (Justice Hall Building) without depositing his firearm at the Security Desk.

    Security Guard Rodulfo P. Rabe politely requested P/SI Buenaobra to deposit his firearm in line with the strict gun ban policy inside the building premises. However, P/SI Buenaobra ignored the request and remarked that if he were to deposit his firearm it is as if he is inside a prison cell and hastened to ask whether or not Mr. Rabe knows that he is the Chief of Police. Whence, he proceeded directly to the chambers of Executive Judge Aniceto B. Galon Jr., Security Guard Rabe went after him and pleaded on him to deposit his firearm which P/SI Buenaobra still ignored.

    In the chambers of Executive Judge Galon, PSI Buenaobra angrily confronted the Judge about the dismissal of Criminal Case No. 8641, entitled People of the Philippines vs. Arsenio Sebag y Navarro, for violation of Sec. 11 par. 3 of R.A. 9165 or the Comprehensive Dangerous Drugs Act and remarked that he would honor for now the order, but next time he would face squarely the judge.
 
    After coming from the chambers of Executive Judge Galon, while walking in the corridor of the building, PSI Buenaobra kept on spitting on the floor and mouthing voluble words until he was already outside of the building premises.

    After leaving the premises, PSI Buenaobra came back and proceeded where Mr. Guillermo Daarol, the Construction and Maintenance Foreman of the Justice Hall, who was seated on top of the U-shaped table in the building's lobby. Upon reaching Daarol, PSI Buenaobra, went berserk, collared Daarol, pushed the chest of the latter and pinned him down on the table then drew his pistol aiming to the head of his hapless victim and began mouthing invectives in Filipino, " Ano Disarmahan mo ako? Kinursunadahan mo ako?",

    Later P/SI Buenaobra backpedaled while still holding his firearm. Employee’s started to mill the place as they were drawn by the commotion created. He then drew another pistol and brandished it, causing the employees to panic and run in different directions.
   
He went back again to Daarol and aimed his firearm to Daarol even in the presence of 3rd Asst. Provincial Prosecutor Lucio O.Tan, and demanded why he (Daarol) has a firearm and not in uniform. Daarol replied that he was unarmed as he lifted the hem of his polo shirt to let Buenaobra see that he has no hidden firearm.

After having been calmed by 3rd Asst. Prov'l Prosecutor Tan, again PSI Buenaobra angrily pointed and threatened Daarol in the presence of Judge Renerio B. Ramas, Presiding Judge of RTC Branch 18, saying in Filipino "lalabas ka rin,".  
 
    The actuation of PSI Buenaobra were done in the presence of several court employees, visitors of the building not to say the least the members of the audit  team of the Supreme Court of the Philippines disrupting the tranquility and the different works in the different offices.

    The Manifesto also stated that “It may be added that on several occasions PSI Buenaobra had openly defied the implementation of the orders and processes of the different courts and the provincial and city prosecution offices by the way of deliberately delaying their implementation and or enforcement, but the courts and the prosecution services instead opted to just let pass his insolence.”

    In the said Manifesto it cited five reasons that, the actuations of the acting Chief of Police PSI Oscar Buenaobra produce the following dared and grave consequences:           

        1. Flagrant affront to the integrity and dignity of the different courts, which pursuant to Administrative Circular No. 1-99 dated January 15, 1999, of the Chief Justice Hilario Davide, Jr., are considered temples of justice and that their dignity and sanctity must, at all times, be preserved and enhance;

        2. Flagrant affront to the integrity and dignity of the different offices of the building, which are line agencies of the Department of Justice;

        3. Flagrant affront to the integrity and dignity of the lawyers themselves whose office of the Integrated Bar of the Philippines is situated at the 2nd floor of the building;

        4. Grave insult to the sense of justice not only to the offices and personnel of the different offices of the building but to the whole populace as well of the city and of the province;

      5. Undermine the respect of the people in the authority and rule of law and it mocked and derided the Institutions. The Supreme Court of the Philippines and the Department of Justice considered as the bastions of Justice which have become themselves victims of a grave injustice.                

        Further, the Manifesto stated “jointly condemned in strongest terms the dastardly, outlandish and brazen display of Arrogance, Gross Misconduct and Grave Abuse of Discretion of PSI Oscas Buenaobra, whose acts evince no other than a Conduct Unbecoming of An Officer and a Gentleman. And from this purpose it is requested and prayed that:

        1. The different judges of the courts will take appropriate action they may deem best to vindicate the honor and integrity of the Institution;

        2. His immediate relief from all his position is forthwith ordered by either of the following: PNP Director General Oscar C. Calderon; PNP Regional Director Police Chief Superintendent Jaime Garcia Caringal and or PNP Provincial Director Police Senior Superintendent Ramon M. Ochotorena."

          As of Press time, P/SI Buenaobra refused to comment on the said manisfesto.
